These terms are an agreement between you and Avatar AI ("we", "us"), the operator of Portiva. By creating an account or using Portiva you accept them. If you do not accept them, do not use Portiva.
The one paragraph that matters most. Portiva is an awareness tool. It reads markets and filings, explains what happened around the positions you tell it about, and keeps the record of your own reasoning. It does not give investment advice, it never recommends buying or selling anything, and nothing it produces is a recommendation, an offer, or a solicitation. We are not a licensed investment adviser, broker, or fiduciary. Every investment decision you make is yours alone, and investments can lose value.
1. What Portiva is
Portiva provides portfolio awareness: a daily brief, notifications you can switch on, an assistant you can question in writing or by voice, and a durable record of the reasoning you choose to write down. Portiva is read-only by construction: it cannot hold your money, access your brokerage account, or execute any transaction.
2. Who may use it
You must be at least 18 and able to enter a contract. If you use Portiva for clients or on behalf of a business, you confirm you are entitled to do so and that your use complies with the rules of your profession and jurisdiction.
3. Your account
Keep your credentials to yourself and tell us promptly if you believe your account has been compromised. You are responsible for activity under your account. We may suspend accounts that threaten the security or integrity of the service.
4. Your content stays yours
The theses, notes, answers, documents and other material you put into Portiva remain yours. You grant us only the licence needed to operate the service: to store, process and display that material back to you, and to generate the briefs and answers you asked for. You can export your record and you can delete it. If you close your account, this licence ends and your data is deleted as described in the Privacy Policy.
5. Market data and content
Portiva draws on market data, filings and news from third-party and public sources. Prices may be delayed, sources may err, and coverage varies by market. We work hard to label what we know and to say when we do not know, but we do not warrant the accuracy, completeness or timeliness of any data or of any generated content. Portiva's briefs and answers are produced with the help of AI systems and can be wrong. Verify anything that matters before acting on it.
6. Acceptable use
Do not misuse the service: no unlawful use, no attempts to break, probe or overload it, no scraping or reselling its output as a data feed, no uploading material you have no right to share, and no using Portiva to provide regulated advice to third parties where you are not licensed to do so.
7. Early access and availability
Portiva is in early access and currently free. The service will change, sometimes substantially; features may be added, altered or withdrawn. We may introduce paid plans, and if we do, nothing you already wrote will be held hostage: your record stays readable and exportable. The service is provided "as is" and "as available", without warranties of any kind, and we do not promise uninterrupted availability.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or any investment losses or trading decisions made in connection with information from Portiva. For everything else, our total liability in any 12 month period is limited to the greater of the amount you paid us in that period or EUR 50. Nothing in these terms excludes liability that cannot lawfully be excluded.
9. Ending things
You can stop using Portiva and delete your account at any time. We may suspend or terminate accounts for material breach of these terms. Sections that by their nature should survive termination (including 4, 5, 8 and 10) survive it.
10. General
These terms are governed by the law of the Slovak Republic, without affecting mandatory consumer protections of the country you live in. If a court finds part of these terms unenforceable, the rest stands. We may update these terms; for significant changes we will notify you by email or in the app, and continued use after the change means acceptance. The date at the top tells you when they last changed.
